YOU GOT A DUI? IT'S NOT THE END OF THE WORLD!

WHAT DO YOU DO NOW?

After you have been cited for an ALCOHOL RELATED incident, such as a DUI, REFUSE THE BREATH TEST or FAIL THE BREATH  TEST, it is very important that you have LEGAL ADVICE.

IF YOU HAVE REFUSED TO TAKE THE BREATH TEST, OREGON LAW SAYS YOUR RIGHT TO DRIVE WILL BE SUSPENDED FOR 12 MONTHS.

If you have taken and failed the test, and this is your first Alcohol Incident in 10 years, the arresting officer will probably cite you for a DUI, but your ticket will allow you to drive for the next 30 days.  Your suspension will start after the 30 days is up.  If this is your situation, your attorney may request a hearing, or that you just plead no contest, and see if you can get into the OREGON ALCOHOL DIVERSION PROGRAM. 

HOWEVER, If you go to court and are CONVICTED OF A DUII, YOUR LICENSE WILL BE SUSPENDED FOR A FULL YEAR AFTER THE CONVICTION DATE.  Also, you may be required to have an IGNITION INTERLOCK device installed in your car when you do get your license back.   After 90 days of the Suspension, you may be able to apply for a Hardship Permit, which would allow you to drive back and forth to work, to drive on the job, and to drive to the court required alcohol treatment program.  In addition to the SR-22 there are other items that DMV and the courts require that must be met in order to get the Hardship License.  AFTER THE 12 MONTHS SUSPENSION IS OVER, YOU WILL STILL HAVE TO HAVE AN SR-22 FOR 3 MORE YEARS.  

If you are put into the DIVERSION PLAN, your suspension will be for 3 months, and you may be eligible for a Hardship License after 30 days. The Hardship License will allow you to drive under the same conditions as stated abave, and to drive to the Diversion Program meetings.
